Part E: Open Questions. You will have 20 seconds to answer each of three questions. The questions will be about family life or personal choices. Each question will be spoken twice, followed by a beep. When you hear the beep, you will have 20 seconds to answer the question. At the end of the 20 seconds, another beep will signal the end of the time you have to answer.

商务信函中的7个"C"原则

写信的原则(Writing Principles)已从原来的3个"C"(Conciseness, Clearness, Courtesy)发展到目前的7个"C":Completeness, Clearness, Concreteness, Conciseness, Correctness, Courtesy, Consideration.

对商业信函的"完整"要求

要求书信的"完整", 理由有三:

1.一封完整的书信比一封不完整的书信,有更大的可能性带来预期的效果;

2.一封完整的书信,有助于建立和表达友善关系;

3.一封完整的书信,可以避免由于遗漏重要情况(情报)所导致的诉讼(Lawsuit);

4. 有时,某些不显眼的书信或文件,由于所提供的情况完整而又生动有力(Complete and Effective)而成为极为重要的文件。

一封信写得是否完整,建议用五个"W"来检验,即:

"Who, What, Where, When 及Why (包括How)"

例如在定货的信中,必须明确说明

"需要什么商品"(What you want)

"何时需要" (When you need the goods)

"货物发到何地何人收"(to Whom and Where the goods to be sent)

"如何付款"(How payment will be made)

如对对方的要求做出否定的答复时(如不能报盘,不能理赔等)应说明理由"为什么"(Why)

当事情发生问题时,任何人都不希望听到的是借口。因此首先要道歉,然后采取行动。如果你回答不出问题或是不能完成某人的请求时,就用"I’m sorry ? 开始。这是避免冲突的的方式。例如,说"I’m sorry, I don’t know the answer."但是不要就此停止!接着说出你将要做的内容。"But I will find out." "I'm sorry"表示出你对他们的关心,用"I will"表示你会帮助他们以安慰他们的情绪。

Would you mind?/Could you?/I'd appreciate.

除非你是top dog(老板),你不要让别人觉得你是在发号施令。用疑问句比用陈述句更能表达你的请求。"Would you mind looking at this report?"或是"Could you take a look at this?" 比以下的句子更恰当,"Look at this report."当你礼貌的提出请求时,同事会更乐意答应你!

In my opinion/I'm afraid I don't agree.

在工作中,要讨论新的想法或是项目时,你需要用礼貌的方式来解释你的想法或是表示你不同意。将短语"In my opinion?用在句首来告诉听者你希望获得各种各样的不同意见。如果你不赞同某人,不要说, "That's the dumbest idea I’ve ever heard!" 而说,"I'm afraid I don’t agree."小心选择你的用词还让和你共同协作的人更愿意听你的意见!批评的艺术

当今的压力重重的商务世界中,最后限期的设定和在此之前完成任务是一个非常棘手的事情。一个掌控的非常好的项目应该有一个实际的时间结构并且能让客户满意。太过乐观的时间结构可能造成过于紧急的最后限期以至于员工需要工作至深夜,我们叫做burning the midnight oil。

没有比不愉快的客户特别是意味着许多钱的大客户更能制造麻烦的了!不用害怕,使用大量的服务技巧,甜言蜜语和一些受用的老式道歉方式来butter-up the customer。别担心,这并不意味着在你的客户身上涂黄油;这仅是指让你的客户感到满意和更合作而已!

掌控灾难

我们来谈谈一些在餐厅内会用到的句子,以及一些跟吃饭有关的单字片语。配合美国的食物介绍一二集来看,相信从此以后到美国餐厅用餐不再是件难事。

1. Do you like to go out eating?

想不想出去吃呢?

有次我问老美出去吃东西怎么说,他回答说一般出去吃饭,他们只说go to eat ,go out eating 或是eat out 而不会说go to dinner,go for lunch,也就是不需特地说中餐或是晚餐。的所以后来老美问我刚去哪了,我应该要说的I just went out eating,而不会说I just went to dinner。小明细多注意,你的英文会更棒。

如果要强调是去吃午餐或晚餐的话,一般就直接说lunch 或是dinner。例如人家问你,“Where did you go?” 你就可答说“lunch。”

2. There is a Deli over there,do you like it?

那里有一家Deli(餐厅),你喜不喜欢呢?

美国的餐厅可分很多种,Restaurant 是一般的通称,另外常用到的有Deli :供应三明治,沙拉这种现成的,不需再经过烹调的餐厅,例如SUBWAY 就可以算是Deli。另外还有Grill 也随处可见,翻译成烤肉餐厅,多半是提供牛排,汉堡热食类的食物。

Deli 这个字是delicatessen 的简写,可是现今在美国一般只会听到deli 而很少听到delicatessen 了!

3. What do you like to drink?

想要喝什么?

美国餐厅的习惯,吃饭时都会点一大杯饮料,所以侍者一定会先问你What do you like to drink。也有人会这么说,Can I get you something to drink?。一般餐厅都会提供的有Coke,Diet Coke,Sprite,Iced Tea,以及Lemonade 等。如果什么都不要,就说Just water。

值得注意的是,在一般的速食店提到drink 都是指soft drink 而言。但是一般人说到have a drink 时,他们多半指的是alcoholic,也就是含酒精的饮料。所以如果有人问你,“Come on, have a drink with us.” 他绝不是要你跟他们一起喝可乐的意思,而是要你跟他们一起喝酒啦!

4. Are you ready to order or just a minute?

你们准备好了吗? 还是要再等一会?

通常饮料上桌之后,大伙都还要花点时间研究一下菜单,如果侍者看你们大概都差不多了,他就会过来问你们,Are you ready to order or just a minute?如果是已经准备好要点餐了,就直接跟她说你想吃什么,如果大家还要再研究研究,则可以跟侍者说Just a minute。或是Wait a few more minutes。请他等一下,他会说OK. I'll beback.(好,那我等下再来。)

5. Do you want to separate check?

你们要不要分开付帐?

比如说二对夫妻出去吃饭,大家想各自付自己的,则你们可以主动跟侍者说的We want to separate check。有时他们也会主动问你,Do you want to separate check?或是Do you want separate checks? 这样的话帐单就会有二张。但有些餐厅separatecheck 会多收服务费,先问清楚。如果是要一起付,则简单地说,together或是one check 就可以了。用外语请人吃饭的三点注意

人是铁饭是钢,不吃一顿饿得慌。在北京还真看到过“饭是钢”的餐厅,可见吃饭的重要性。中国人早就有这种说法,尽管“民以食为天”是旧的习俗,但是传统意义上的吃饭已经衍生为现代重要的交流与沟通的方式,它与你我的生活已经密不可分。人与人之间的交流、生意人之间的谈判、同事之间的沟通、亲人之间的亲密等等,但请客吃饭有一点是有共性的,那就是不管你的目的是谈生意还是与人约会,最终的打算是让对方高兴而来满意而去。

如何安排请人吃饭呢?以下几点务必注意:

一、在你请人吃饭的时候,你应该首先问问人家:"What are you in the mood for?"“您想吃什么?”"mood"这里有心情、心绪的意思,这句话中"be in the mood for"是一个固定的用法,意思是“想吃什么?”当然,如果这种用法用到别的地方,就有了不同的理解。比如,看到了电,你会这样问:"Are you in mood for a movie?"意思是“你想看一场电影吗?”自然,"for"后面还可以用"dancing,shopping,oking等。但是千万不要说成"Are you in the mood?"这样就会引起人的误会了。

二、最重要的一点你可千万别忘记了,那就是谁请客的问题。一般经过你的倡议自然是你请客了,也就是你应该说"I'll treat you."“我请客。”当然,如果你请的外国人提议"separate checks",那就是中国人所谓的AA制了,也就是分别买单的意思,你吃多少就要付多少钱。如果是"split the bill",那就有区别了,一般这种宴请不会出现,那是平摊帐单的意思。在中国,一般同学、同事聚会就会用到最后一种。

三、最后一点可是人命关天了,那就是大家一起结伴出行吃饭,事先应决定谁开车的问题。面对美酒会开车的朋友自然要牺牲一位了,不然一旦都喝了酒,回来的时候可就泡了汤,谁也不敢开,谁也不能开了,谁来是违章,大伙的性命最重要。因此,大家在出行前会问"Who's gonna drive?"“谁来开车呢?”"gonna"是典型的美语,表示即将发生的事,其实就是"going to",同样,还有"wanna"即"want to",用法很特殊。这句话也可以说成"Who's driving"?但这种说法不如第一种流行。

让我强调一下我们做的这笔订单的重要性。NO TRICKS:商务谈判中的八字箴言

商业经营中诚信非常重要。中国自古就有“货真价实,童叟无欺”的八字箴言,英文中也有一个八字经典:NO TRICKS。从字面看来,它与中文的意义非常相近。不过“NO TRICKS”并不仅仅代表字面的意思,每一个字母还有更深一层的含义--谈判中的八种能力。

谈判能力在每种谈判中都起到重要作用,无论是商务谈判、外交谈判,还是劳务谈判。在买卖谈判中,双方谈判能力的强弱差异决定了谈判结果的差别。 对于谈判中的每一方来说,谈判能力都来源于八个方面,就是 NO TRICKS 每个字母所代表的八个单词--need,options,time,relationships,investment,credibility,knowledge,skills。

1. “N”代表需求(need)

对于买卖双方来说,谁的需求更强烈一些?如果买方的需要较多,卖方就拥有相对较强的谈判力。卖方越希望卖出产品,买方就拥有较强的谈判力。

2. “O”代表选择(options)

如果谈判不能最后达成协议,那么双方会有什么选择?如果你可选择的机会越多,对方认为你的产品或服务是的或者没有太多选择余地,你就拥有较强的谈判资本。

3. “T”代表时间(time)

主要是指谈判中可能出现的有时间限制的紧急事件,如果买方受时间的压力,自然会增强卖方的的谈判力。

4. “R”代表关系(relationships)

如果与顾客之间建立强有力的关系,在同潜在顾客谈判时就会拥有关系力。但是,也许有的顾客觉得卖方只是为了推销,因而不愿建立深入的关系。这样。在谈判过程中将会比较吃力。

5. “I”代表投资(investment)

在谈判过程中投入了多少时间和精力?为此投入越多、对达成协议越多的一方往往拥有较少的谈判力。

6. “C”代表可信性(credibility)

如果潜在顾客对产品的可信性也是谈判力的一种,如果推销人员知道你曾经使用过某种产品,而他的产品具有价格和质量等方面的优势时,无疑会增强卖方的可信性,但这一点并不能决定最后是否能成交。

7. “K”代表知识(knowledge)

知识就是力量。如果你充分了解顾客的问题和需求,并预测到你的产品能如何满足顾客的需求,你的知识无疑增强了对顾客的谈判力。反之,如果顾客对产品拥有更多的知识和经验,顾客就有较强的谈判力。

8. “S”代表的是技能(skills)

这可能是增强谈判力最重要的内容了,不过,谈判技巧是综合的学问,需要广博的知识、雄辩的口才、灵敏的思维……

总之,在商业谈判中,应该善于利用“NO TRICKS”中的每种力,当然还要做到NO TRICKS。 合约中“人”的含义

将合约中所牵涉到的特定用语加以定义,是很重要的工作,目的在将语言有限的精确性提升到,尽量限制对同一词语作出不同解释的可能性,以避免法律关系的模糊不清引发争议。例如专利权授权契约的当事人对于营业秘密的保护,可能有以下的约定:

The Licensee shall not divulge to any third person any trade secret having to do with the business of the Licensor that shall come to the knowledge of the Licensee by reason of this Agreement, during the term of this Agreement and for three years after the termination of this Agreement.

被授权人于本合约期间及本合约终止后三年内期间,不得将因本合约而得知授权人之营业秘密,泄露给任何其它第三人。

这样的约定看起来已经很完整了,除了 Licensee、Licensor 及 Agreement这几个大写词通常会在这个条款出现于合约之前,就给予适当的定义以外,还有什么概念需要定义呢?问题就出在于 any third person 里面的 person 这个概念,究竟范围如何?"自然人"包括在内或许没有问题,但是"法人"属于这里所说的 person 吗?或许依照合约上下文可以推知,当事人的意思里 person 包括"公司",那么"合伙组织"算不算是这个条款里要规范的 person 呢?为避免这种解释上的困扰,同时也为避免意图违约的当事人玩文字游戏,当事人就会考虑在合约第一条加入以下的定义条款:

"Person" means-

(i) a natural person & and any corporation or other entity which is given, or is recognized as having, legal personality by the law of any country or territory; or

(ii) any unincorporated association or unincorporated body of persons, whether formed in the United Kingdom or elsewhere, including a partnership, joint venture or consortium.

本合约所称“人”包括:

(i) 自然人、法人、或依照任何国家或领域之法律,享有法人格之主体。

(ii) 在英国或其它地域所组成之非法人组织,例如合伙组织、合资组织、财团组织等等。

如果要特别表示“自然人”(natural person),而排除“法人”的概念,通常会使用 individual来代替 person 这个字,可以减少疑义。

依照同样的道理,英文合约中常常出现的,还有以下对于“单、复数”及“阴、阳性”名词的范围定义:

"Stock Certificate" includes "stock certificate" and "stock certificates".

"He" includes "he" and "she".

"His" includes "his" and "her".

"Him" includes "him" and "her".

本合约所称“股票”,包括单数与复数。
